 If you are charged with DUI and refused to take the breathalyzer test, your license may be suspended for a period of 1 year for a first refusal and 18 months for a second refusal. You have only 10 days from the date of arrest to request a formal review of your driver’s license suspension. I will assist you in submitting the hearing request at no charge. If you are convicted of driving while under the influence, the penalties you are subject to include: up to six months imprisonment, up to 1 year driver license revocation, a fine between $250-$500, completion of a substance abuse course, vehicle impoundment for 10 days and 50 hours community service for the first offense. Penalties for the second or subsequent offenses vary depending upon whether you are charged with a felony or a misdemeanor and the date of your prior offense. If you are convicted of driving with a suspended license, the penalties include: up to 60 days imprisonment and a fine of $500 for the first offense and up to 1 year imprisonment and a fine of $1000 for a second offense. Penalties for the third or subsequent offense vary depending upon whether you are charged with a felony or a misdemeanor. In addition to other penalties, if you are convicted of drug possession, prostitution or issuing a worthless check your driver’s license may be revoked for up to 2 years. |
